Ordering & Order Acceptance
YOUR ORDER CONFIRMATION OR E-MAIL RECEIPT IS NOT A CONTRACT, but only a record of your offer to purchase a particular item at a particular price.

By placing your order, you agree to accept all terms and conditions set forth anywhere on this web site.

After you place an order, Pursenickity will determine whether or not to fill the order. Pursenickity reserves the right to refuse to fill your order for any reason, including, but not limited to, the unavailability of a product, or errors in the prices and product descriptions posted on this web site.

By placing your order, you agree that Pursenickity's total liability, under any legal theory or claim, shall be limited to the purchase price actually paid to Pursenickity for the product giving rise to Pursenickity's liability.

Pursenickity makes no guarantee that any item listed on our web site will be available for sale at any specific time. While we endeavor to offer the widest selection of items for sale at all times, because of the dynamic nature of our business our inventories are constantly changing and these changes may not be fully reflected on our web site.

Prices stated on our web site or any other commercial postings are current at the time of posting, but may be subject to change without notice.

Pursenickity will ship items per buyer's request, at buyer's expense. Pursenickity recommends that every buyer purchase insurance for all items purchased. Pursenickity is not responsible for, and accepts no liability for, damages caused during shipping, and any damages incurred during shipping will void any and all guarantees. All claims for damages incurred during shipping should be directed to the shipping company.

100% Money Back Guarantee
All products that are off-the-shelf, stock items, and/or are naturally-colored can be returned for a 100% refund. Custom-made purses, dyed items, special order items, special length items, special clearance items, and items sold "as is" are not included in this guarantee.

If our company made the error we will gladly refund the shipping as well, otherwise all shipping charges will be the responsibility of the buyer.

After owning our products for 7 days, we know that you will want to keep them and they will not be accepted for return under our 100% money back guarantee.

Exclusions From Guarantee
Larger quantities of purses, bags, dyed feathers and boas, or other products, i.e. more than 5 items, may be accepted for return at our sole discretion - please contact us first. There will be a minimum 25% restocking fee assessed on all returned feather and boa orders. Larger quantities of dyed and bleached or colored products will probably not be accepted for return, or will be assessed a much larger restocking fee.

There are no returns on any custom-made purses, custom-dyed items, special-order items, special-length or special-cut items. Special clearance items and items sold "as is" are not included in this guarantee.

Wholesale orders are not generally returnable. A restocking fee of at least 35% will be assessed on all wholesale orders that are returned.

Returns
If you wish to return an item, please notify the office by e-mail, telephone or fax within 5 business days of the delivery date of the merchandise, at which time we will issue a return authorization number (if return is approved). When your return is approved, we will send you a copy of the authorization form by your choice of either e-mail, fax, or regular mail.

You must clearly mark the return authorization code on the outside of the box the items are being returned in, and include a copy of the authorization form inside the box with the items. No returns will be accepted or acknowledged without a return authorization number issued by our company being clearly marked on the box.

There will be a minimum restocking fee of 25% assessed on all items accepted for return by Pursenickity which fall outside of our 100% money back guarantee service. There is no restocking fee for any item which is included in our 100% money back guarantee service.

If you requested express processing and/or express shipping and then return the merchandise, we will not refund either of these charges if the order was processed and shipped as requested.

Shipping
All prices listed on this web site are FOB Hurst, TX and exclude shipping and handling unless otherwise indicated.

Pursenickity will utilize the least expensive method to ship orders received from you unless you direct us to do otherwise. Shipping is an added cost on all orders. Additional services charged by shipping carriers like FedEx© or UPS© are added to your shipping costs. For more information on using express shipping services please CLICK HERE.

FedEx©, UPS©, and the other shipping carrier services we use all require a valid telephone number at all delivery destinations. If you request an alternative shipping address, and do not provide a telephone number for the alternative shipping address, we have the right to ship the item to the main address you supplied.

Shortages & Order Discrepancies
After we have shipped your order and after you have received your order, it is your responsibility to check the contents of the order immediately.

OUR OFFICE MUST BE NOTIFIED WITHIN 48 HOURS OF RECEIPT about any shortages or other discrepancies in your order.

Receipt is deemed to have taken place when FedEx©, UPS© or any other carrier we use has documented that the package(s) have been delivered. No claims for shortages or discrepancies will be accepted after 48 hours from receipt.

Please check your order immediately upon receipt. If any visible damage to your package is noted upon receipt, please inform the carrier, then contact us.

Payments
All orders are prepaid. We accept Visa, MasterCard, Discover, American Express, and e-checks through PayPal. We also accept payments by check and money orders, however, these orders will not be processed until the funds have cleared the banking system.

Retail Order Processing Times
Most of our retail Web purse orders are shipped within 7 - 10 business days from receipt of your order.

Most of our other off-the-shelf items, stock items, and/or naturally-colored items will ship within 5 - 7 business days.

All custom-made purses, dyed items (including feathers and boas), special-order items, and special-length or special-cut items are usually shipped within 10 - 14 business days.

We do offer an express processing service. All orders which require express order processing are subject to a 35% surcharge plus the extra cost of express delivery. We will attempt to process all express processing orders within 5 - 7 business days, this includes custom purses and custom-dyed feather and boa products.

Wholesale Order Processing Times
Please allow 4 - 6 weeks for wholesale orders to ship. All wholesale orders which require express processing will also incur a 25% surcharge.

Minimum retail order is $15.00, excluding shipping & handling charges.
Minimum wholesale order is $125.00, excluding shipping & handling charges.

Boa Order Processing Times
Feather and boa colors are not identical. The standard processing time for dyed boa products is 10 - 14 business days. A surcharge of 35% will automatically be added to each product item for express processing of boa orders and we will attempt to process these orders in 5 - 7 business days.

Boas and boa products are not colorfast. Our company accepts no liability for colors running. DO NOT ATTEMPT TO WASH BOAS OR BOA PRODUCTS!

Custom boa dyeing is available and there is an extra $75 per color, per product, per style. Add about 4 weeks delivery time to the normal delivery times listed above.

All boas are a standard 2 yard (6 feet - 1.84 meters) length. Other sizes are available for special orders. Contact us for specific pricing information on special-length cuts.

Price Changes
We reserve the right to change our items listed for sale, the prices of those items, and the specifications of those items without prior notice.

Coupons & Sales
Credits against future purchases, refunds, or any special coupons we issue are available for redemption against our normal Internet retail pricing only, and cannot be combined with other coupons, sales or special offers we may make available from time to time.

Dispute Resolution
All disputes, or problems of any kind, that you cannot get resolved through our Customer Support Department should be initially directed to our offices via USPS mail, return receipt requested.

YOU AGREE THAT ANY DISPUTE ARISING BETWEEN PURSENICKITY AND YOU, REGARDLESS OF THE KIND OR CHARACTER OF THE DISPUTE, MUST BE RESOLVED THROUGH ARBITRATION. YOU AGREE TO SUBMIT ANY SUCH DISPUTE TO ARBITRATION BEFORE THE AMERICAN ARBITRATION ASSOCIATION IN DALLAS, TEXAS, AND FURTHER AGREE TO BE BOUND BY THE DETERMINATION OF ANY ARBITRATOR(S) EMPANELED BY THE AMERICAN ARBITRATION ASSOCIATION TO ADJUDICATE ANY SUCH DISPUTE. ALL COSTS OF ARBITRATION UNDER THIS SECTION WILL BE PAID BY THE PARTY THAT INITIATES THE ARBITRATION.
